Before launch

The highlighted values below are placeholders. Replace the legal entity, the contact address and the governing law with the real ones, and have this document reviewed, before charging anyone.

Dayling Pulse is a website monitoring service operated by [legal entity, address, company number] (“we”, “us”). These terms are the agreement between us and you when you create an account or use the service. If you do not agree with them, please do not use Dayling Pulse.

1. What the service does

Dayling Pulse checks websites you tell it to watch, from the outside and read-only, the way a visitor would. It looks at availability, the security certificate, response time, links and pages, and a small set of technical SEO signals. It then summarises what it found as a health score, alerts and reports written in plain English.

Dayling Pulse does not modify your website, does not need a password to it, and never receives access to your hosting.

2. Your account

  • You need an account to use the service. You must give accurate details and keep your sign-in credentials to yourself.
  • You are responsible for everything done through your account. Tell us as soon as you suspect someone else is using it.
  • You must be at least 16 years old, or the age of digital consent where you live, and if you sign up on behalf of an organisation you confirm you may bind it to these terms.

3. Acceptable use

Monitoring somebody else’s website without their agreement is the one thing we will not host. When you add a site, you confirm that you own it or that its owner has asked you to look after it.

  • Do not add a site you are not authorised to monitor, and remove any site you stop being responsible for.
  • Do not use the service to probe, load-test, scrape or attack anything — Dayling Pulse is a health check, not a testing tool.
  • Do not try to circumvent plan limits, rate limits or the checks we run on submitted addresses.
  • Do not resell or rebrand the service as your own. White-label reporting is not part of what we offer today.

We may refuse or stop monitoring an address that puts us, you or a third party at risk, and we will tell you when we do.

4. Plans, payment and cancellation

  • The free plan is free, for one site, with no card required and no time limit.
  • Paid plans are billed monthly in advance, in euros, through our payment provider. Prices are shown on the pricing page and include or exclude tax as indicated at checkout.
  • You can cancel at any time from your billing screen. Cancelling stops the next renewal; your plan stays active until the end of the period you have already paid for. We do not pro-rate partial months.
  • If a payment fails, we may move your account back to the free plan and its limits until the payment succeeds.
  • If we change a price, we will tell you by email at least 30 days before it applies to your subscription.

5. What we promise, and what we do not

We work hard to run the checks on schedule and to describe what we find accurately. We cannot promise more than that, and it is fairer to say so plainly:

  • Monitoring is periodic, not continuous. A problem that starts and ends between two checks may go unseen.
  • A check runs over the public internet. Network conditions, rate limiting or a firewall on your side can produce a result that does not reflect what your visitors experience.
  • Alerts and recommendations are informational. They are not a security audit, a legal opinion, or a substitute for your own judgement or your provider’s advice.
  • The service is provided “as is”, without warranties beyond those your local law gives you and that cannot be waived.

6. Availability and changes

We may update, add or remove features, and we may take the service down for maintenance. For anything planned that would interrupt monitoring significantly, we will give notice by email where we reasonably can.

7. Liability

To the extent the law allows, we are not liable for indirect or consequential loss — lost revenue, lost data, lost business or reputational harm — arising from your use of the service or from a problem on your website that Dayling Pulse did not detect. Where we are liable, our total liability over any twelve month period is limited to the amount you paid us during that period.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

8. Your data

The addresses you monitor and the results we produce are yours. We use them to run the service, and we describe exactly what we store and who processes it in our Privacy Policy. You can export or delete your data from the app at any time.

9. Suspension and termination

You can close your account whenever you like; doing so deletes your sites and their history. We may suspend or close an account that breaks these terms, that we are required to stop serving, or that has been inactive on a free plan for more than twelve months — with notice, and with a chance to put things right whenever that is reasonable.

10. Changes to these terms

We may update these terms as the service evolves. If a change matters to you, we will email you before it takes effect. Continuing to use Dayling Pulse after that date means you accept the new version.

11. Governing law and contact

These terms are governed by the laws of [jurisdiction], and disputes go to the courts of [jurisdiction], without affecting any right you have to bring a claim where you live as a consumer.
